How night differential pay is computed in the Philippines

Under Article 86 of the Labor Code, every covered employee who works between 10:00 PM and 6:00 AM is entitled to a night shift differential of at least 10% of their basic hourly rate for each hour worked within that window. It is a legal minimum — many BPO and manufacturing employers pay more, and the higher company rate prevails.

The 10% is computed on the hourly rate that already reflects the day type. So a night hour on a regular holiday earns 200% of the basic hourly rate, and the night differential is 10% of that holiday rate — not 10% of the plain rate. Overtime hours worked at night carry the overtime premium first, then the 10% night differential on top.

Your basic hourly rate comes from your daily rate divided by 8. If you are paid monthly, the common conversion is monthly rate × 12 ÷ 261 working days ÷ 8 hours for a Monday-to-Friday schedule (313 days for a six-day week).

  • Night differential = basic hourly rate × day-type multiplier × 10% × night hours worked.
  • Night hours only count between 10:00 PM and 6:00 AM, even if your shift starts earlier.
  • Overtime at night: hourly rate × overtime multiplier × 1.10 for each overtime hour inside the night window.
  • Managerial employees, field personnel, and family members dependent on the employer for support are excluded from the statutory night differential.
  • Night differential forms part of your taxable compensation but is not part of basic salary for 13th month pay purposes.

How do you compute night differential in the Philippines?

Multiply your basic hourly rate by 10% for every hour worked between 10:00 PM and 6:00 AM. For example, at a ₱100 hourly rate, eight night hours earn ₱80 of night differential on top of your regular pay.

What hours count as night shift in the Philippines?

Only the hours between 10:00 PM and 6:00 AM. A shift from 8:00 PM to 5:00 AM therefore has seven night-differential hours, not nine.

Is night differential 10% or 20%?

The legal minimum under the Labor Code is 10% of the basic hourly rate. Some employers, especially in BPO and healthcare, pay 15% to 30% by company policy or collective bargaining agreement — the higher rate applies.

Is night differential taxable in the Philippines?

Yes for most employees. However, night shift differential earned by a minimum wage earner classified as a statutory Minimum Wage Earner is exempt from income tax, along with their holiday pay, overtime pay, and hazard pay.

How is night differential computed on a holiday?

Apply the holiday premium first. On a regular holiday your hourly rate is 200% of basic, so the night differential is 10% of that 200% rate — meaning each night hour on a regular holiday pays 220% of your basic hourly rate.

Do I get both overtime and night differential?

Yes. If your overtime hours fall between 10:00 PM and 6:00 AM you receive the overtime premium plus the 10% night differential computed on the overtime rate.
